Equa Series - Terms of use for the online service (www.equaseries.com)

1. General information

Welcome to the Equa Series ("Equa") online service (the "Service"). You are advised to read these Terms of Use (the "Terms") carefully before using the Service.

These Terms apply to all user activities on the Service, regardless of the terminal device used to access the Service. You may only use the Service in accordance with the Terms and applicable law and good practice in force from time to time. In addition, the Service may contain sections or functions (such as an online shop), the use of which is subject, in addition to these Terms, to specific conditions or instructions provided separately on the Service and may require registration.

The Terms constitute an agreement between the user and Equa, and define the rights and obligations of the user and Equa with respect to the Service.

By using the Service, you agree to be bound by the then-current Terms and Conditions and to abide by them, as well as by the terms and conditions and instructions provided separately on the Service.

3.        Processing of personal data

Equa processes personal data about the user obtained through the Service in the manner permitted and required by the applicable personal data legislation. The Privacy Policy of the register based on Equa's customer relationship and other material connection describes the processing of personal data in more detail.

4.     Cookies

The Service may use cookies or other similar technologies to collect information related to the user's terminal device or use of the Service, such as the page from which the user arrived at the Service, the browser used by the user, or when and which parts of the Service the user has browsed. A cookie is a small text file that may be delivered to a user's terminal equipment through the Service.

Cookies enable, for example, the processing of the number of users of the Service and other data related to the use of the Service. The information obtained can be used to analyse and improve the performance of the Service and make it more personalised for the user. In addition, the collected data can be used to target marketing to the user that is likely to be of interest to him or her, both on and off the Service, for example through re-marketing.

Users can prevent cookies from working if they so wish by changing their browser settings. However, the User should note that blocking or deleting cookies may adversely affect or even prevent the use of the Service or certain parts or functions of the Service.        

5.     Rights and restrictions on use of the Service

Equa grants you a limited, revocable, non-exclusive, personal right to use the Service and its content as set forth in these Terms only in accordance with these Terms and any separate terms and instructions that may be provided on the Service. You may use the Service and its content only for your personal, non-commercial use.

You may not modify or reproduce the Service or any part of the Service or its content. The User shall not distribute, disseminate, transmit, publicly perform or otherwise make available to the public the Service or its content, either as is or as modified, unless expressly permitted in these Terms. If the Service contains an express option to transmit the content of the Service to social media services (so-called social media buttons), such transmission shall not be deemed to be in breach of these Terms.

The User has the right to take a printout or copy of the content of the Service or to save a copy on his/her own terminal for his/her own private use. In all such printouts and recordings, the User shall retain the copyright and other rights notices contained in the Service.

You may not interrupt or attempt to interrupt or otherwise interfere with or attempt to interfere with the operation of the Service or the ability of other users to use the Service in any way. Prohibited activities include, but are not limited to, placing timed jamming software, viruses or other material that contains elements that may affect the software structure of the Service on the Service.

You may not use the Service (a) to impersonate an Eqa representative; (b) to falsify or manipulate header or identification information in a manner intended to disguise the origin of any content transmitted through the Service; (c) to otherwise provide false information; (d) to store or collect personal information about other users; (e) to transmit spam or other unauthorized communications; or (f) to engage in any other activity that is unlawful or improper.

6. Service changes

The service and its content are provided "as is". Equa may modify or change the Service or its content at any time without notice or liability. Equa shall therefore be entitled, among other things, to change or modify the products or prices described in the Service, to add or remove parts of the Service, and to change free sections of the Service into paid sections or vice versa. Equa also has the right at any time to suspend or discontinue the Service, its content or any portion thereof, or to restrict access to the Service or any portion thereof. If you have acted in violation of these Terms, any terms or instructions specifically provided on the Service, or any law or custom, Equa shall have the right to block your access to the Service and prohibit your further use of the Service.

7. Registration

Registration may be required to access certain parts of the Service in order to obtain the access described above. Access to sections requiring registration may be limited to natural persons or legal entities on a section-by-section basis.

When registering as a user of the Service, the user must provide the correct information requested. Providing false information is prohibited and may result in penalties.

When registering, the user chooses a username and password. The user is responsible for the careful storage and confidentiality of the password and is responsible for all transactions on the Service using his/her user name. The User shall immediately contact Equa if the User discovers or suspects that his/her identifiers have been compromised or misused. Equa has the right to suspend or block a user's account.                        

8. Links to external sites and external links to the Service contained in the Service

The Service may contain links to websites owned and operated by third parties. The linked sites are in no way under the control of Equa and Equa does not control or review the content of the linked sites. Equa is not responsible for the content, accuracy, reliability or security of the linked sites.

Using links to external sites takes you away from the Service, and you use the linked sites at your own risk. You are advised to carefully read the terms and conditions and guidelines of the linked site before using that site.

9. Intellectual property rights

The Service and its content, such as texts, images, product information, trademarks and logos, are the property of Equa or its partners and are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and registrations.

All intellectual property rights (such as copyrights, registered and unregistered trademarks and design rights, domain names, patents, database rights and trade secrets) in the Service and Content and the goodwill arising from the use thereof belong to Equa or its partners. Equa does not grant the user any direct or indirect rights to any intellectual property rights.

10.  Limitations of liability

Equa shall endeavour to keep the Service available to the user at all times and without interruption. However, Equa does not guarantee that the Service will be available to you without interruption, in a timely manner or without error. The Service and its contents are provided to the user "as is". Equa is not responsible for the accuracy, reliability, errors, omissions, inaccuracies or other defects in the information or content transmitted through the Service.

Equa cannot guarantee the security of the Service, its content or the information transmitted through the Service, and is not responsible for ensuring that electronic communications sent through the Service are free of viruses or other harmful components. Furthermore, Equa shall not be liable for any information or content sent or received by a user through the Service or not sent or received.

The service may not be available in all countries and may only be available in certain languages. The Service, its functionality or some features may be dependent on the compatibility of the devices used, network connections, and content formats.

Equa shall not be liable for any direct, indirect, consequential, special or punitive damages, including damages for loss of business, contracts, profits, data or business interruption, arising out of or in connection with the use or inability to use the Service or its content or these Terms, whether in contract, tort, negligence or otherwise, even if Equa has been advised in advance of the possibility of such damages. In all cases, the liability of Equa shall always be limited to the maximum liability provided by mandatory law.

You hereby release Equa and all of its employees, directors and agents from liability for any and all claims and actions arising out of your use of the Service.

11.  Changes to terms and notifications

Equa reserves the right to change these Terms at its discretion by notifying the user by email or through the Service. Changes to the Terms will take effect upon notification. Use of the Service after the date of notification shall be deemed to constitute acceptance by the user of the changes to the Terms.

Equa may include notifications in the Service. Equa may also send notices to the user regarding the Service to the email address or telephone number provided by the user. Notices shall be deemed received seven (7) days after they are sent or posted by Equa. Continued use of the Service means that the User shall be deemed to have received all notices regardless of the method of transmission.

12.  Applicable law and dispute resolution

The use of the Service and these Terms are governed by Finnish law, without regard to its conflict of law provisions.

The Parties shall endeavour to settle any disagreement through negotiation as a matter of priority. If no amicable settlement can be reached, the dispute will be settled by the Helsinki District Court in Finland. The consumer user may also submit the dispute to the competent district court or consumer dispute board according to his/her place of residence.
